Artist Payouts. If you are an artist, you may connect royalty statements and receive payouts under separate agreements. Crowdsurf does not guarantee any specific royalties.
5. PROHIBITED CONDUCT
You agree not to:
Post content that infringes third‑party rights, is illegal, hateful, or sexually explicit.
Use the Service for spam, data scraping, or unauthorized advertising.
Reverse engineer, decompile, or attempt to extract source code.
Circumvent security features or access non‑public areas of the Service.
Engage in any activity that could harm Crowdsurf or its users.
6. SUBSCRIPTIONS & IN‑APP PURCHASES
Certain features may require payment (e.g., $5.99/month subscription). Fees are billed in advance and are non‑refundable except as required by law. Taxes may apply.
7. THIRD‑PARTY SERVICES
The Service integrates APIs and links to third‑party platforms such as Spotify, Apple Music, and YouTube. Crowdsurf is not responsible for third‑party content or practices. Your use of those services is governed by their respective terms.

9. COPYRIGHT & DMCA POLICY
If you believe content on Crowdsurf infringes your copyright, please submit a notice to dmca@crowdsurf.com with the information required by 17 U.S.C. §512(c)(3). We respond to valid takedown requests and may terminate repeat infringers.
10. TERMINATION
You may delete your account at any time in the app settings. Crowdsurf may suspend or terminate your account if you violate these Terms or engage in fraud or abuse. Upon termination, the license granted in Section 4.2 expires, but Sections 8, 11, 12, and 13 survive.
11. DISCLAIMER OF WARRANTIES
Crowdsurf is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted or error‑free.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Crowdsurf, its affiliates, and their officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service.
13. INDEMNITY
You agree to defend, indemnify, and hold harmless Crowdsurf and its affiliates from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of your violation of these Terms or your User Content.
14. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Delaware, without regard to conflict‑of‑law principles. Any dispute arising under these Terms will be resolved through binding arbitration administered by JAMS under its Streamlined Rules. You waive any right to participate in class‑action litigation.
15. MODIFICATIONS
We may update these Terms from time to time. We will notify you of material changes via email or in‑app notice. Continued use of the Service after the effective date constitutes acceptance.
16. MISCELLANEOUS
